By accessing or using polysurfacemarketing.com(the “Site”) or submitting our lead form, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Site.

The Site is operated by PolySurface Marketing, a marketing agency for floor-coating contractors based in Minneapolis, MN(“PolySurface,” “we,” “us,” or “our”).

The Site provides information about our services and a form to request a strategy call or more information. The content here is for general informational purposes and is not a binding offer or a guarantee of results. Any engagement for paid services is governed by a separate written agreement between you and PolySurface; if that agreement conflicts with these terms, the signed agreement controls for that engagement.

You must be at least 18 years old and able to form a binding contract to use the Site or submit the form. By submitting, you represent that the information you provide is accurate and that you are authorized to provide it.

When you submit the form, you check a box providing express written consent to be contacted. By doing so, you agree that PolySurface may contact you by phone call, text/SMS, and email — including by automated means — about your inquiry and our services. Consent is not a condition of any purchase, message and data rates may apply, and you can opt out at any time (reply STOP to texts, ask us to stop calling, or unsubscribe from emails). You agree not to:

• Submit false, misleading, or someone else's information without authorization.
• Use the form to send spam, or attempt to overwhelm, probe, or disrupt the Site or its abuse protections.
• Attempt to gain unauthorized access to the Site, the dashboard, or any underlying systems or data.
• Use the Site or its content in violation of any applicable law or third-party right.
• Scrape, copy, or reuse Site content for a competing service without our permission.

The Site and its content — text, design, graphics, logos, and the PolySurface name and marks — are owned by PolySurface or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive license to view the Site for the purpose of considering our services. All rights not expressly granted are reserved.

The Site may link to third-party websites or rely on third-party services (such as a scheduling calendar). We do not control and are not responsible for the content, policies, or practices of those third parties. Your use of them is at your own risk and subject to their terms.

Marketing outcomes depend on many factors outside our control, including your market, budget, offer, and follow-up. Any examples, case studies, or figures on the Site are illustrative and not a promise of any specific result. We do not warrant any particular number of leads, jobs, or revenue.

The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, PolySurface and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site — even if we have been advised of the possibility. Our total liability for any claim related to the Site is limited to the greater of the amount you paid us, if any, for the matter giving rise to the claim, or US $100.

You agree to indemnify and hold harmless PolySurface from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these terms, or your violation of any law or third-party right.

These terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Minneapolis, MN for any dispute that is not subject to a separate signed agreement.

We may update these terms from time to time. When we do, we will revise the “Effective date” above; continued use of the Site after changes means you accept the updated terms.
